EPA Dragging Feet On Animal Feedlot Regs, DC Circ. Told

Law360, Washington (April 2, 2015, 6:36 PM EDT) -- A group of Iowa residents urged a D.C. Circuit panel Thursday to let them challenge the Environmental Protection Agency’s inaction on animal feed operations, saying the agency has taken too long to list the pollutants from those facilities as stationary sources of pollution under the Clean Air Act.

The group is appealing U.S. District Judge Richard Leon’s June ruling that the CAA does not impose a nondiscretionary duty on the EPA to regulate emissions from animal feeding operations or the AFOs as emissions sources. The EPA...
