Opposing Counsel OK For In-N-Out Trademark Suit

Law360, New York (July 28, 2008, 12:00 AM EDT) -- Local counsel that previously represented In-N-Out Burgers may represent its opposition in a different trademark infringement suit involving the fast food chain, a federal judge has ruled.

A magistrate judge in the U.S. District Court for the District of Nevada filed the order Thursday to deny In-N-Out Burgers' motion to disqualify defendant In & Out Tire & Auto Inc.'s counsel.

An attorney for In-N-Out Burgers said the company would appeal the ruling to the district judge.
