Whirlpool Takes Hit In Faulty Fridge Case

Law360 (July 29, 2008, 12:00 AM EDT) -- Whirlpool Corp. has suffered a blow in a purported class action over allegedly defective ice chutes in the company's side-by-side refrigerator models, with a federal judge letting the lion's share of the plaintiff's claims move forward.

In a ruling Friday, Judge Christopher Boyko of the U.S. District Court for the Northern District of Ohio shot down Whirlpool's motion to toss plaintiff Marcia Nessle's complaint after finding she had sufficiently pled the three elements required to allege a claim under the Ohio Consumer Sales Practices Act....
