Aventis Files Patent Suit Over Generic Allergy Drug

Law360, New York (May 4, 2006, 12:00 AM EDT) -- In an attempt to protect the market share for its Nasacort AQ nasal spray, Aventis Pharmaceuticals Inc. filed a lawsuit Tuesday to stop Barr Laboratories Inc. from making a generic version of the anti-allergy treatment.

The complaint filed on behalf of Aventis in a federal court in Delaware references two patents, which were granted in 1999 and 2000 to an inventor named Soo Il-Kim. Kim was employed at the time by a company that was a “predecessor-in-interest” to Aventis, thus giving Aventis ownership of the patents...
