SOX Whistleblower Defense Fails In Pa. Trial

Law360, New York (July 30, 2008, 12:00 AM EDT) -- A Pennsylvania jury has found against a former chief operating officer for a food services company who claimed he was fired, in violation of the whistleblower provision of the Sarbanes-Oxley Act, after he uncovered securities fraud at the company.

The jury in the U.S. District Court for the Eastern District of Pennsylvania returned its verdict July 18 in favor of Nutrition Management Services Co., which provides food services to nursing homes, finding that Richard Blagrave had not proven that the company retaliated against him.
