EPA Neglected Everglades: Judge

Law360, New York (August 4, 2008, 12:00 AM EDT) -- A federal judge in Florida has ruled that the U.S. Environmental Protection Agency “arbitrarily and capriciously” violated the Clean Water Act by turning a “blind eye” to 2003 amendments to the state's Everglades Forever Act.

U.S. District Judge Alan Gold of the Southern District of Florida ruled on July 29 that the EPA had also erred in its review of the state's Phosphorus Rule concerning acceptable levels of that chemical in state water.
