Kimberly-Clark Joins Hydrogen Peroxide Cartel Fight

Law360, New York (August 5, 2008, 12:00 AM EDT) -- A group of paper companies, including Kimberly-Clark Corp. and Smurfit-Stone Container Enterprises, has filed suit against chemical maker FMC Corp. in an attempt to bust an alleged hydrogen peroxide cartel in the United States and Europe.

The suit, filed Monday in the U.S. District Court for the Eastern District of Pennsylvania, alleges that FMC, its European subsidiary FMC Foret SA and unidentified co-conspirators violated federal antitrust law by price-fixing and allocating markets for hydrogen peroxide between 1998 and 2002.
