Barr And Eli Lilly Head Back To Court Over Prozac

Law360, New York (May 11, 2006, 12:00 AM EDT) -- Five years after successfully challenging a patent for Eli Lilly’s blockbuster antidepressant Prozac, Barr Laboratories and Eli Lilly will meet again in court, this time over a reissue patent for the drug.

The suit, filed by Lilly in the U.S. District Court for the Southern District of Indiana, seeks a patent infringement ruling for the patents challenged by Barr, and a declaratory judgment ruling upholding the validity of the patent.
