Huggies Ad Injunction Request Denied

Law360, New York (August 8, 2008, 12:00 AM EDT) -- A judge has denied Procter & Gamble's request for a preliminary injunction and has allowed Kimberly-Clark Corp. to go ahead with a national ad campaign for its Huggies diapers.

P&G is seeking relief under the Lanham Act for what it called a "false and misleading advertising campaign” by Kimberly-Clark.

Kimberly-Clark's ads suggest its Huggies diapers are designed for "babies of the human variety" while an image on-screen suggests competitors' diapers are designed to fit bricks. In a magazine version, the ad says, “If bricks had babies,...
