FAA Says Watchdog's Drone Privacy Suit Is Premature

Law360, Washington (May 19, 2015, 3:56 PM EDT) -- A privacy watchdog filed its suit challenging a proposed rule on commercial drone use too early, the Federal Aviation Administration has told the D.C. Circuit, saying only final rules can be reviewed by the court.

Proposed rules — like the one the FAA floated in February to regulate the routine commercial use of small unmanned aerial systems — are only meant to give notice of an agency's planned course of action and invite public comment, the FAA said Friday. But the Electronic Privacy Information Center's suit contesting the privacy safeguards in the proposed drone rule is premature because there is nothing to be reviewed...
