Judge Won't Expand W.R. Grace Stay To Mont. Claims

Law360, New York (August 13, 2008, 12:00 AM EDT) -- A federal judge dashed W.R. Grace & Co.’s hopes for an expanded injunction against asbestos litigation Tuesday, affirming the bankruptcy court’s decision to let plaintiffs pursue claims in Montana state court.

Judge Ronald L. Buckwalter of the the U.S. District Court for the District of Delaware found that the plaintiffs, a group of individuals allegedly injured by asbestos exposure from W.R. Grace’s mining operation in Libby, Mont., are free to pursue negligence claims against the state of Montana.
