Chancery Puts Alpha On Hook For Ex-Massey CEO's Atty Fees

Law360, New York (May 28, 2015, 2:57 PM EDT) -- Massey Energy Co.'s parent will have to pay former CEO Don Blankenship's legal expenses as he fights criminal charges over a deadly 2010 mine explosion, now that a Delaware Chancery judge ruled Thursday that an “unusual” undertaking pact does not allow for termination of the executive’s legal cover.

Whether Blankenship is entitled to legal protection from Alpha Appalachia Holdings Inc., which bought Massey in 2011, hinged on Chancellor Andre G. Bouchard’s reading of a contingency provision in the undertaking agreement. Massey had argued the provision justified...
