3rd Circ. Tosses Landfill Spat Back To Lower Court

Law360, New York (August 14, 2008, 12:00 AM EDT) -- The U.S. Court of Appeals for the Third Circuit has reversed and remanded a 2006 ruling that found a Pennsylvania county erred in forcing a private trash hauler to use the county-owned landfill rather than take advantage of cheaper disposal options.

On Wednesday, the Third Circuit handed Lebanon County and the affiliated Greater Lebanon Refuse Authority a temporary victory in its waste war by overturning the district court’s unfavorable decision and remanding the case back to the lower court for further consideration.
