7th Circ. Sides With Female Detention Officers

Law360, New York (August 21, 2008, 12:00 AM EDT) -- An appeals court has ruled that a juvenile detention center violated the Civil Rights Act with a gender-specific staffing policy that effectively reduced the available shifts for women.

On Wednesday, the U.S. Court of Appeals for the 7th Circuit reversed a lower court's ruling that allowed a juvenile detention center's “same-sex role models” policy. The 7th Circuit rejected the lower court's conclusion that allowing only male officers to supervise boys during certain shifts was a “bona fide occupational qualification” allowed under civil rights law.
