Fed. Circ. Revives Star Scientific's Suit Against RJR

Law360, New York (August 26, 2008, 12:00 AM EDT) -- An appeals court has ruled that a lawsuit by Star Scientific Inc. against R.J. Reynolds Tobacco Co. over patents that cover a method for curing tobacco can go forward, reversing a lower court's decision to dismiss the case.

Judge Paul R. Michel of the U.S. Court of Appeals for the Federal Circuit ruled Monday that a district court erred when it dismissed Star's suit on the grounds that the patents it asserted were indefinite and unenforceable due to inequitable conduct.
