Family Can't Sue US To Clean Up Land: 10th Circ.

Law360, New York (August 27, 2008, 12:00 AM EDT) -- The descendants of a Utah landowner who leased his land to the United States during World War II can't seek relief for the lasting damage of the military's chemical weapons testing, an appellate court has ruled.

On Tuesday, the U.S. Court of Appeals for the 10th Circuit upheld a lower court's ruling that the family's lawsuit would interfere with the government's pending cleanup efforts and violate the Comprehensive Environmental Response Compensation and Liability Act.
