Whole Foods Asks For FTC Judge Swap

Law360, New York (August 28, 2008, 12:00 AM EDT) -- Whole Foods Market Inc. has asked the U.S. Federal Trade Commission to remove an administrative law judge appointed to its case, saying someone other than an FTC commissioner should preside so that the company can get a fair shake in the judgment on its acquisition of Wild Oats Markets Inc.

In documents filed with the FTC on Aug. 22 and posted on the commission’s Web site Wednesday, lawyers from the natural foods store said that the commissioners have prejudged the legality of the company’s $565 million...
