Vioxx Judge Caps Legal Fees At 32 Percent

Law360, New York (August 28, 2008, 12:00 AM EDT) -- Fees for plaintiffs' attorneys involved in the $4.85 billion Vioxx settlement will not constitute more than 32 percent of the total award, the judge presiding over much of the case has ruled.

Judge Elden Fallon of the U.S. District Court for the Eastern District of Louisiana said in a ruling Wednesday that he set the relatively low cap on fees, which is below the usual percentage of between 33 and 40 percent, in an effort to make sure the fees were reasonable.
