Judge Sides With Superfund Plaintiffs In Expert Spat
By Anne Urda (September 2, 2008, 12:00 AM EDT) -- The federal judge presiding over a case involving a Superfund site has shot down a bid by International Paper Company and the other defendants to toss out one of the plaintiffs' expert testimonies on the grounds of it being untimely.
On Friday, Chief U.S. Magistrate Judge Raymond Erickson denied the defendants' joint informal motion to exclude the expert testimony of Dr. William R. Sawyer, handing the plaintiffs a minor win in their ongoing environmental property battle.
