10th Circ. Upholds Navajo Class Action Against Utah

Law360, New York (September 4, 2008, 12:00 AM EDT) -- An appeals court Wednesday jolted the state of Utah, upholding claims by members of the Navajo Nation who seek a full accounting of gas and oil royalties to a fund that the Navajo have repeatedly accused the state of mismanaging.

Judges Carlos F. Lucero, Michael R. Murphy and Julie A. Robinson of the U.S. Court of Appeals for the Tenth Circuit rebuffed Utah's contention that the plaintiffs had already been adequately represented in past lawsuits alleging mismanagement of the Navajo Trust Fund.
