9th Circ. Affirms US Claim On Pacific Atoll

Law360, New York (September 5, 2008, 12:00 AM EDT) -- An appeals court on Thursday sank a challenge to the United States' ownership of a protected Pacific atoll, upholding a district court's decision to dismiss the action as time-barred.

The U.S. Court of Appeals for the Ninth Circuit affirmed the lower court’s decision to dismiss the action on statute of limitation grounds, as the lawsuit disputing U.S. ownership of the Kingman Reef atoll under the Quiet Title Act was filed more than 12 years after the plaintiff knew of the government’s claim on the island....
