Md. Appeals Court Affirms Lilly Car Crash Ruling

Law360, New York (September 5, 2008, 12:00 AM EDT) -- Maryland's highest court has ruled that Eli Lilly & Co. bears no responsibility for the death of a motorist in a car crash caused by a diabetic driver who suffered a debilitating episode while taking medication made by the pharmaceutical company.

In a unanimous decision, the Maryland Court of Appeals said Thursday that Lilly didn't have a duty to warn someone who wasn't taking its medication. Judge Irma S. Raker also penned a concurrence.
