Bridgeview Wins Hay-Baling Patent Spat In Fed. Circ.

Law360, New York (September 15, 2008, 12:00 AM EDT) -- A federal appellate court decided in favor of “Bale King” maker Bridgeview Manufacturing Inc. on Friday, vacating and remanding a lower court's ruling that Duratech Industries International Inc. had not infringed on its hay-baling technology.

The U.S. Court of Appeals for the Federal Circuit found that the district court had misconstrued a critical element of the patent claim as a “means-plus-function limitation,” which protects an element in a claim in terms of the function it performs.
