PEC Sues Over N.C. Superfund Cleanup

Law360, New York (September 15, 2008, 12:00 AM EDT) -- Utility company Progress Energy Carolinas Inc. has sued 28 other potentially responsible parties to recover cleanup costs associated with a former electrical transformer manufacturing site near the Raleigh-Durham International Airport, asserting its rights under the Comprehensive Environmental Response Compensation and Liability Act.

In the suit filed Friday in the U.S. District Court for the Eastern District of North Carolina, PEC said it has already paid approximately $9.1 million into a trust created to administer the costs of removing soil contaminated with polychlorinated biphenyls from the Superfund...
