Judge OKs Suit Against EPA Over Marine Terminal

Law360, New York (September 15, 2008, 12:00 AM EDT) -- A federal judge has denied the U.S. Environmental Protection Agency's motion to dismiss an environmental group's lawsuit over permits for a Charleston, S.C., marine container terminal and highway.

The South Carolina Coastal Conservation League alleges that the EPA breached its duties under the Clean Water Act by failing to review permits for the $1.2 billion terminal and highway project, and violated the Administrative Procedures Act by acting capriciously.
