EPA Moves To Dismiss Cases In Water Transfer Spat

Law360, New York (September 16, 2008, 12:00 AM EDT) -- The U.S. Environmental Protection Agency is seeking to stay or toss three lawsuits challenging a new rule regulating restrictions on water transfers under the Clean Water Act until an appellate court can make a decision in the matter.

In a motion filed Monday in the U.S. District Court for the Southern District of Florida, EPA claimed the suits dealt with the same issues already before the appellate court on appeal in another case and in parallel requests for judicial review of the water transfers rule....
