Caregiving Spouse's Wages Not Recoverable: Ohio SC

Law360 (September 17, 2008, 12:00 AM EDT) -- If your husband or wife suffers a debilitating injury, you may have some tough choices to make in Ohio.

The Supreme Court of Ohio ruled Tuesday that an injured party cannot sue for a spouse's lost wages if that spouse chose to take time off from work and stay home as the caregiver. The injured spouse may recover only the market value of the care provided by the caregiving spouse, the court said, joining the majority of state courts that have addressed this question.
