10th Circ. Narrowly Rejects Wittig's Appeal En Banc

Law360 (September 19, 2008, 12:00 AM EDT) -- A 6-5 majority of appeals judges on Tuesday voted en banc to reject the appeal of a two-year jail sentence for David Wittig, the former chief executive of public utility Westar Energy Inc., for bank fraud.

In June, a three-judge panel of the U.S. Court of Appeals for the Tenth Circuit said the sentence of David C. Wittig was appropriate. The same court had twice vacated and remanded Wittig's prior sentences of 51 months and 60 months, saying they were excessive.
