Ky. Appeals Court OKs Power Plant Permit

Law360, New York (September 23, 2008, 12:00 AM EDT) -- The Kentucky Court of Appeals has overturned a lower court's decision to revoke a permit for a coal-fired power plant, opening the door to construction of a 1,600 megawatt plant in the western part of the state.

The appeal revolves around an order issued by the Franklin Circuit Court last year that the Kentucky Environmental and Public Protection Cabinet review a 2002 permit to build the Thoroughbred Energy Campus near Central City, Ky.
