CVS Workers Call For Review In FLSA Case

Law360, New York (September 26, 2008, 12:00 AM EDT) -- A group of pharmacy technicians that filed a wage-and-hour action against CVS Caremark Corp. has asked a federal judge to reconsider his dismissal of two plaintiffs in the case.

The summary judgment order in favor of the drug store chain on the claims of technicians Jennifer Mejia and Lena Chesser was based on “material misrepresentations of evidence,” the plaintiffs told Judge Donald L. Graham of the U.S. District Court for the Southern District of Florida on Friday.
