Monsanto Prevails In Pa. Pollution Suit

Law360, New York (September 29, 2008, 12:00 AM EDT) -- Pennsylvania has failed to convince the state supreme court to overturn its previous ruling that undid a $90 million verdict against the Monsanto Co. for chemical contamination.

Ruling on the state Department of General Services' appeal, the Supreme Court of Pennsylvania sided with Monsanto's argument that the polychlorinated biphenyls were likely discharged when the building caught fire and not as a result of the ordinary and intended use of products containing the substances.
