Biocare Wins Bid To Drop AsymmetRx Patent Suit

Law360, New York (September 30, 2008, 12:00 AM EDT) -- A federal judge sided against medical device manufacturer AsymmetRx Inc. on cross-motions for summary judgment Monday, dismissing the company's claims against the last remaining rival diagnostic company in a suit over two patents describing certain antibodies used to diagnose prostate cancer.

Judge Richard G. Stearns of the U.S. District Court for the District of Massachusetts also denied AsymmetRx's motion for a preliminary injunction against Concord, Calif.-based Biocare Medical LLC and closed the case that originally included four other companies that sell the antibodies.
