Geico Loses 11th Circ. Rehearing Bid In Bad Faith Case
Law360, New York (October 1, 2015, 9:31 PM EDT) -- The Eleventh Circuit on Thursday refused to hear en banc a breach-of-contract lawsuit against Geico General Insurance Co., delivering another defeat for the insurance company in its battle with a driver who alleges it failed to properly settle a personal injury claim from a traffic collision.
In a one-page decision, the appeals court denied Geico’s petition for rehearing by a panel or the entire court, which, barring a further appeal, marks the end of Geico’s battle with Daniel Diperna, who sued Geico and its insured driver after an auto accident.
