Abbott Unit's Injunction Bid Denied In Stent Spat

Law360, New York (September 30, 2008, 12:00 AM EDT) -- A federal judge denied a permanent injunction bid from an Abbot Laboratories subsidiary that took aim at Medtronic Inc.'s Endeavor drug-eluting stent, the latest development in a long-running battle over stent patents.

Judge Sue Robinson of the U.S. District Court for the District of Delaware denied plaintiff Advanced Cardiovascular Systems Inc.'s bid for a permanent injunction on Friday, and declined to enjoin Medtronic's production of its Endeavor stent, which the court said infringes ACS' patents because it incorporates the “Driver” stent.
