11th Circ. Prohibits CRA From Altering Health Benefits

Law360, New York (October 1, 2008, 12:00 AM EDT) -- Reversing a lower court decision, an appeals court on Tuesday determined that a prior settlement agreement bars CRA Holdings Inc. from requiring retirees of an acquired company to make monthly contributions to the health care plan.

Judges Stanley F. Birch, Peter T. Fay and William S. Duffey Jr. of the U.S. Court of Appeals for the 11th Circuit ruled that a $50 monthly contribution implemented in 2005 by CRA violated an agreement reached with retirees of Transway International Corporation, which CRA acquired in 1985.
