Court Rejects Qwest's Attorney-Client Privilege Defense

Law360 (June 21, 2006, 12:00 AM EDT) -- A federal appeals court has struck down a request by Qwest Communications International Inc. to withhold 220,000 pages of documents from shareholders suing the Denver-based company for alleged securities fraud.

In a 50-page opinion dated June 19, the Tenth Circuit Court of Appeals refuted Qwest’s argument that the documents at issue—which had already been produced to the U.S. Securities and Exchange Commission and the Department of Justice—were exempt from disclosure because of attorney-client privilege.
