$1M Punitive Award Against Tyson Foods Tossed

Law360, New York (October 2, 2008, 12:00 AM EDT) -- A federal judge has thrown out a $1 million punitive damages verdict in a race discrimination case filed by a former Tyson Foods Inc. employee after ruling that the company cannot be held liable for a punitive award.

U.S. Magistrate Judge Robert R. Armstrong of the U.S. District Court for the Northern District of Alabama said Tuesday that punitive damages were not in order because Tyson Foods had not approved the discrimination that plaintiff John Hithon was subjected to.
