FERC's Comments On MMS Alternative Energy Rule

Law360, New York (October 8, 2008, 12:00 AM EDT) -- Federal Energy Regulatory Commission ("FERC") comments, dated Aug. 28, 2008, on the Mineral Management Service ("MMS") proposed rule on alternative energy and alternate use of the outer continental shelf ("OCS") recommend that MMS remove wave and ocean current energy from the proposed rule. The MMS proposed rule was published on July 9, 2008.

Specifically, FERC recommends that MMS not issue any rule applicable to wave and ocean current projects that would interfere with FERC's regulatory responsibilities under the Federal Power Act ("FPA") or frustrate orderly development...
