PTO Didn't Broaden Predicate Logic Patent: Fed. Circ.

Law360, New York (October 10, 2008, 12:00 AM EDT) -- An appellate judge has ruled that a patent suit brought by Predicate Logic Inc. against Distributive Software Inc. over a method used in developing software can go forward, reversing a lower court's decision that a patent asserted by Predicate Logic is invalid.

Judge Richard Linn, of the U.S. Court of Appeals for the Federal Circuit, ruled Thursday that a lower court had erred when it concluded that the U.S. Patent and Trademark Office broadened the scope of Predicate Logic's patent by amending it during a re-examination....
