High Court To Decide Split On Appellate Review Issue

Law360, New York (October 14, 2008, 12:00 AM EDT) -- The U.S. Supreme Court will hear a patent inventorship case involving California-based pharmaceutical company Carlsbad Technology Inc. to decide a procedural question on when litigants are able to appeal a remand of their case to state court.

The high court granted writ of certiorari Tuesday to a petition from Carlsbad, the U.S. subsidiary of a Taiwanese pharmaceutical company mired in litigation over who owns inventor rights to the anti-cancer agent YC-1.
