High Court Won't Hear Planned Parenthood FOIA Request Suit

Law360, New York (November 16, 2015, 9:42 PM EST) -- The U.S. Supreme Court on Monday denied a petition challenging a First Circuit decision upholding the U.S. Department of Health and Human Services’ refusal to disclose a Planned Parenthood document under the Freedom of Information Act, despite a dissent calling for a review of a trade secrets exemption to the law.

The court didn’t accept the petition from anti-abortion group New Hampshire Right to Life, although Justices Antonin Scalia and Clarence Thomas dissented, saying that the circuit courts still disagree with how to handle the FOIA exemption dealing with confidential trade secrets.
