Court Upholds Permit For Duke Coal Plant

Law360, New York (October 17, 2008, 12:00 AM EDT) -- A court in Indiana ruled Thursday that state regulators correctly issued a permit to Duke Energy Corp. to build a 630-megawatt, $2.35 billion coal gasification power plant last year.

The decision by the Indiana Court of Appeals dealt a blow to a coalition of environmental groups that had petitioned the court to reopen the permit for further review.

The plant is in southwestern Indiana. Construction of the plant, which has already begun, is expected to be completed in 2012.
