Skinner Ch 11. Case Still OK To Proceed: 3rd Circ.

Law360, New York (October 20, 2008, 12:00 AM EDT) -- The U.S. Court of Appeals for the Third Circuit has rejected a bid to dismiss Skinner Engine Co.'s Chapter 11 case, ruling that the asbestos litigation-plagued manufacturer should be allowed to continue working on its plan of reorganization.

On Thursday, the Third Circuit shot down the appeal brought by Hartford Accident and Indemnity Co. and other insurance companies, agreeing with the lower courts that the Chapter 11 case was not being pursued for the wrong reasons.
