Canadian Court Tosses Kyoto Implementation Suit

Law360 (October 21, 2008, 12:00 AM EDT) -- A Canadian court ruled Monday that the Canadian government does not have to abide by the terms of the Kyoto Protocol on climate change, which the current conservative government refuses to implement despite the country's ratification of the treaty.

In a blow to Canadian environmentalists, including Friends of the Earth Canada, which filed the suit, Canada's Federal Court ruled that the court has no grounds for determining whether the Canadian government violated its international obligations by enacting the Kyoto Protocol Implementation Act.
