EC Issues Notice Outlining Merger Remedies

Law360, New York (October 22, 2008, 12:00 AM EDT) -- On Wednesday, the European Competition Commission released an updated notice aimed at clarifying and formalizing proposed merger remedies.

The new rules, effective immediately, replace a set of rules released in 2001 and serve as a preemptive clarification point for the procedures and possible outcomes of merger remedies.

Remedies — a key factor in complex European Union merger cases — refer to the practice of a company making compromises or changes in order to secure conditional merger approvals under EU regulations.
