Law360, New York (October 22, 2008, 12:00 AM EDT) -- The European Commission wrongfully determined that funds channeled by the Kingdom of Denmark to a public television channel amounted to state aid because it did not conduct a thorough investigation of the underlying economics of the financing, the Court of First Instance of the European Communities has ruled.
In a decision handed down on Wednesday, the court annulled the commission's findings, which had been challenged by a Danish commercial television network and the public television network as well as Denmark.
