Citizen Petitions Come Under Fire In Pharma War

Law360 (July 6, 2006, 12:00 AM EDT) -- As generic drug makers continue to wrestle for their share of the pharmaceutical industry, the practice of filing citizen petitions has been attacked, with critics accusing brand name drug makers of exploiting the tool to unfairly shut generics out of the marketplace.

Some members of Congress, including Senator Trent Lott and Senator Debbie Stabenow, have alleged that the brand name drug industry has subverted the citizen petition process in yet another attempt to stave off generic competition.
