Md. Judge To Preside Over Tyson Marketing MDL

Law360 (October 23, 2008, 12:00 AM EDT) -- A consolidated putative class action alleging Tyson Foods Inc. misled consumers by marketing chicken as “Raised Without Antibiotics” will be heard by a judge in Maryland federal court despite Tyson’s contention that the judge could be unfair to the company.

The multidistrict litigation case, which consolidates nine putative class action cases, has been assigned to Judge Richard D. Bennett in U.S. District Court for the District of Maryland, according to a transfer order issued Friday by the Judicial Panel on Multidistrict Litigation.
