The Disabling Effects Of The ADAAA

Law360 (October 23, 2008, 12:00 AM EDT) -- On Jan. 1, 2009, the ADA Amendments Act of 2008 (“ADAAA”) takes effect. The Act, which is intended to expand the definition of disability under the Americans with Disabilities Act (“ADA”), was signed into law on Sept. 25, 2008 by President Bush.

What does this mean for employers? It means that many employees who were not disabled under the ADA may now be considered disabled and, therefore, eligible for an accommodation and protected from discrimination.
