Lawsuit Targets Director Of USPTO

Law360 (July 10, 2006, 12:00 AM EDT) -- The Director of the U.S. Patent and Trademark Office is a defendant in a federal patent suit filed in Virginia by a subsidiary of Farmingdale, N.Y.-based biotech company Enzo Biochem Inc.

The lawsuit, filed July 3, appeals an adverse decision by the Board of Patent Appeals and Interferences (BPAI), which held that a patent application assigned to Enzo was abandoned and lapsed, thus giving an Israeli research and development firm a chance to patent the disputed technology for itself.
